EXCEPT AS PROVIDED IN THIS PARAGRAPH, IN NO EVENT WILL PREMIERLASH™ OR THE PREMIERLASH™ ENTITIES BE LIABLE FOR ANY CLAIMS, DEMANDS, DAMAGES, LIABILITIES, SUITS, ATTACHMENTS, JUDGMENTS, LOSSES, PENALTIES, FINES, SETTLEMENTS, EXPENSES (INCLUDING COURT COSTS AND REASONABLE ATTORNEYS' FEES INCIDENT THERETO), OR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, ECONOMIC, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, RELATING TO OR ARISING FROM THE PURCHASE, USE OR MISUSE OF PRODUCTS OR SERVICES SOLD BY PREMIERLASH, LLC, AND PURCHASER AGREES TO INDEMNIFY, DEFEND AND HOLD HARMLESS PREMIERLASH™ AND THE PREMIERLASH™ ENTITIES FOR ALL SUCH CLAIMS AND ACTIONS.

[_] Rights Reserved: PremierLash™ reserves the right to refuse sales and or services to anyone, for any reason, at any time. PremierLash™, in its sole discretion, reserves the right to prohibit use, or any affiliate’s use, of its brand name or logo. Substandard work or careless by the technician would constitute cause for refusal.

The re-sale of PremierLash™ products and materials (including, but not limited to, application supplies, merchandise, etc.) to third-party individuals or marketplaces is not permitted.

[_] Communication: Except as otherwise noted in our Privacy Policy, any communication or material transmitted by you to PremierLash™ by electronic mail or otherwise, including any data, questions, comments,suggestions or otherwise, shall be treated as non-­confidential and non-proprietary.

[_] Agreement: This Agreement shall be governed by and is construed in accordance with the laws of the State Utah, without giving effect to the principles of conflicts of laws thereof.

Any dispute arising under this Agreement shall be settled by arbitration in the State of Utah.

This Agreement, constitutes the entire agreement between the parties as to the subject matter hereof and shall supersede all prior understandings, letters, agreements, contracts and other documents.

By purchasing products or services from this website, Purchaser and PremierLash, LLC agree that any dispute arising from the purchase or use of any products or services from PremierLash, LLC shall be settled by arbitration administered by the American Arbitration Association (AAA) in the State of Utah, in accordance with the AAA’s Commercial Arbitration Rules.
